if you can go to biometric center within 10 days of original appointment and do a walk-in on a walk-in date, usually WED;

go to biometric center and hand over the originals (after keeping a copy) and ask them to reschdule and give them for ex., any date after 25th OCT 2007.

U R better off rescheduling your mexico appointment - its something that could be done within next 3 to 4 months for sure. Technically, you can do that. But it's better for you to transer your case to consular processing if you are not planning to be in the US for a couple years.
I forget to mention that it is for my wife. she is my dependent with EAD and AP. i know if she have green card she have to stay 6 months in usa. it that applies to EAD and AP also.

If I were you, I would just do a little search in the forum and close this thread. There was an extensive discussion on this very topic for days and the thread had to be eventually closed because it was taking ugly turns. Let's not go that route again. Your I - 94 Validity cannot be at a date later than H1-B. You say you got your first H1B visa till Oct 2005, but I - 94 expires in Nov 2005. I donot think it can happen
Third country Nationals can go to Mexico and get thier Visa stamped. The only thing is if your Visa gets refused for some reason, you will have to fly back to home coutry and get it stamped.
Have not heard such cases though.

Hi Every one,
I'm on OPT right now ,i'm done with my masters in DEC 2007.
My visa Stamp in my passport was only untill april 2008(I got F1 stamped only for 24 months), now i'm on OPT extension.I applied H1B in 2008 and got RFE my employer could not answer the RFE and revoked my petition.
I did't apply in 2009 even i have chance to apply(because of the JOB fear ) i got my OPT extension approved ,my OPT extension is going to end in June 2010 , any way i will be applying H1B in 2010.
My question is if i don't get H1B in 2010 ,my plan i to take CPT and search for jobs ,does it effects my future immigration any way.

Hmm ... Are you still enrolled in your school as a student in good standing? AFAIK, you can avail CPT only during your study period, not after it.

Could you all please give me an opinion on this situation? I am trying to ask my lawyer, but I won't know for a few days and this is disturbing me a lot!
I am on H1, 7th year extension. My Labor just got approved. About to file 140. Now my project has apparently lost funding and the employer is offering me a temp job for 6 months till my 140 gets approved so I can use the approved 140 and move. But the catch is the new job requires a new H1 - different job description and pay. Will this affect my 140 filed with the old H1?
Let your lawyer confirm this: Get your I140 approval, if possible by using premium filing. File for a 3 year H1 extension. After extension, transfer H1 to new employer. Start GC process with new employer but maintaining your PD since your old employer aill not revoke your I140.

My company applied for my L1B petition in 2007 which was approved and I got an L1 visa in Mar 2007 which was valid until Aug 2009. However I traveled to the U.S only in December 2008. Since my L1 visa was expiring by Aug I applied for a L1 extension in May 2009. This was rejected in August due to some confusion with the I-94. So I had to travel back to India in Aug 2009.
I then applied for a fresh L1 visa based on my company's L1 Blanket petition. I got this new L1 visa in Sep 2009 and returned back to the U.S. This new visa is valid until Sep 2011.
My question is can I apply for another L1 extension?
Will my visa duration or stay duration be considered when applying for another extension?
I have stayed in the U.S on L1 status only from Dec 2008 - Am I not allowed 5 years?
Also I am not sure whether I have exhausted my quota of extensions. Will my case be considered as 2.5 years the first time and 2 years extension the second time?
Or will the Blanket visa be considered a fresh start allowing me another extension?
Also what will happen if I transfer to H1 at this point of time ... will my L1 stay duration or my L1 visa duration be considered when deciding the H1 visa validity?
Please help with some answers...

My friend has a question. His wifes H1 got approved. As of now she doesnt have job. What if she gets job in dec/Jan. There wont be any pay roll for october and november. Will this create any problem at the time of visa stamping in India if she goes for vaction later in next year.

I am a UK citizen brought up in India. I am in US now working on H1-B. Since I plan to return to India after few years for good, I decided to apply for OCI(overseas citizens of India)/dual citizenship of India.
I will have to apply for green card after few years to maintain my employee status here in USA.
Now, the question is, will I get privilege if I am UK citizen compared to dual citizen of India when I apply for US green card?
If I get any privilege(like quicker processing time, etc) I will just get a visitor's visa/PIO card of India for now.
Please advice. I am really confused. Thank you.

My wife last time entered to US with H4 in June 2010. Then she applied for F1 status and got approved in Nov 2010.
H4 visa stamping Expires on Feb 20111.
