DHS will be rescinding its July 2 update and the initial July Visa Bulletin will take effect for 31 days � i.e., all employment-based green card categories (except for the �Other Workers� category) will be �current� and CIS will accept applications through August 17.

USCIS is all about balancing work...they are being forced to accept butt-load of AOS application, and they shift the balance this way....
Also they will take months or even years to send back receipts EADs etc...wait n watch....we made them swallow the tought pill, and they will make the same pill stuck in our throat for eternity now.....

My wife's H1 ends and before it expires she is leaving for home country, there she will apply for h4 to come back on.
Do we need to file change of status form for her?

in home country She gets H4 stamp..When she enters US again she gets H4 status..

Maximum 6 entries are allowed each year under AP, as per a 1998 circular of DHS. You may have to be careful.

I have a question. I have a student visa now from last 4 years and before these student visa I started a small business in India. i didnt expected it to grow much but now it has grown. I have used money from that business for my 2nd MS which is not completed yet
Here is the problem
I am getting married in May. Till May I can stay here legally but than once I leave and get married I want to come with my Wife. So I have 3 options
She apply alone for visitor visa ( chances are less for these)
She come as dependent ( I dont have any income here or any source of income from college)
I leave my student visa and we both apply for visitor visa. These option has a lot of risk but its the best I am thinking as I am not interested in going to college anymore
What you think which route I should take?

I came in US with my family when I was 15-16, back then we were on L2, then as time passed by we switched to H4. Then I turned 21 so I had to go on Student Visa (F1). Still living in US legally.
Now my question is I've been staying in US over 10 years now, legally. I dont know if its rumor or not, but someone told me, that you can apply for Green Card if you lived in US over 10 years legally, is that true?
Going through all that H1B process sounds really hectic. Also all my family members, friends and relatives are here, I don't know anyone back in my birthplace. any suggestions or tips, would help a bit.

I am a UK citizen brought up in India. I am in US now working on H1-B. Since I plan to return to India after few years for good, I decided to apply for OCI(overseas citizens of India)/dual citizenship of India.
I will have to apply for green card after few years to maintain my employee status here in USA.
Now, the question is, will I get privilege if I am UK citizen compared to dual citizen of India when I apply for US green card?
If I get any privilege(like quicker processing time, etc) I will just get a visitor's visa/PIO card of India for now.
Please advice. I am really confused. Thank you.

I had filed my 485 during the VB fiasco, but did not file for ead/ap, as my H1 was valid. I intend to apply now but not sure what the filing fee is? Can one of you guys who might have filed later guide me on what the fee amount is and the documents that need to go with it. Is Efiling an option?
USCIS website says $340 for the EAD and $304 for AP, but I guess it is the new fee and does not apply to folks who had their AOS filed before July 30, 07.

Situation is this:

If for whatever reason my H1B extension is denied then what are my options? First off, would it invalidate my I-485 application as it is employment based.
I believe if the answer to above is no, then I can just use my EAD and continue working.

Thanks. It seems I can not extend my J1 (Research Scholar) visa after getting the HRR waiver. Is anyobe aware of any foreign travel restrictions on a valid J1 visa with a granted HRR waiver?

I think the only way you can know about it is by looking at Receipt notice you will get in mail. I believe every individual/case has a unique number.
