USCIS denied my and my family's 485 based on withdrawl of old pending 140.
How did you come to know about your denial. Did they send a denial notice after you applied for EAD. Was there any status change on the USCIS website after your 140 was revoked by employer.

You left out the crucial piece of info...what is your nationality? What country is your passport from? THAT, not your residency in Sweden, will determine whether or not you need a transit visa. You can use the site below to find out. Just fill in all the blanks and click for the info.

Seek a competent lawyer's help. There is a "nunc pro tunc" option . Since you applied for the initial amendment in May 2009 after your expiration of OPT, they would have to check if any grace period applies or if it could be done in your case for "change of Status". But worth the try, in either case you make sure you are not "out of status".

I traveled (together with my family) through this route last year with the same circumstances you are in. There will be no problem and they won't ask you for any documents. If your flight on return is from Dubai to any US city, they will see your AP, Passport. If you have a valid AP at that time then they will allow you back.

Please see below I-140 ref. I do understand that they need me to submit an experience letter including employment date and specific duties, but how to handle the second evidence? If the specific duties on my previous employer�s experience letter already includes those H14 specific skill and other requirements, is that enough? Or I will still need to find something else to support/proof them? Thanks!

Hi, I am actually in a similar boat as you. Though I have an April 2006 PD for EB3 and am now on EAD as well.
Question1: Is it better to try and port my EB3 to EB2 with a different employer. Isn't GC for future employment ? If so, can't I negotiate with another employer and file new labour under EB2 and try and port my priority date from EB3 ? Also, if I do this will my current employer find out ?
Questions2: What is the process for porting EB3 to EB2 without current employer finding out ? What documents are required ? My current employer is not going to give me a copy of my I-140 or my Labour Cert. All I have is the receipt notice of my I-485 filing and my AP/EAD documents.
Questions3: Is it possible that since there are so many India EB2 applicants and fewer India EB3 applicants that it is better to stick with EB3 April 2006 PD ? Dosen't a seperate quota get allocated to EB3 than that which gets allocated to EB2 each year or will EB3 always be behind EB2? Please advise.

Dear all,
I just realized that my lawyer forgot to mention A# in my 485 application. I have an approved I140 and the approval notice does have A# mentioned on it.
Does any one in this forum know if I am in trouble? I have sent a copy of my I-140 approval notice in my application though.
Any thoughts/experience?

HI,
I am in my 7th yr extension of H1B, last time I got the stamping in Ottawa in 2005. I cam e into US on F1 and never got H1B stamping in India. Am I eligible for H1B stamping in Canada for my 8th year or should I go to India to get the stamping done.
